Law No. 2025-594 of June 30, 2025, against public aid fraud has reversed cold calling logic. Since August 11, 2026, calling a consumer to sell a good or service is prohibited by principle, regardless of sector. This article summarizes the rules and changes for B2B sales teams. It does not replace legal advice.

What changed on August 11, 2026

  • Before: individuals could be called unless registered on Bloctel (opt-out logic).
  • Since August 11, 2026: they can only be called if they have given clear prior consent, or if the call concerns an active contract.
  • The Bloctel service, now obsolete, is abolished.
  • Decree No. 2026-662 of July 23, 2026, specifies how to collect, store, and withdraw this consent.

Before obtaining consent, the professional must inform the person: who they are or who they are calling for, the purpose of the calls, and the duration of the consent's validity. They must be able to prove this consent and allow it to be easily withdrawn.

And in B2B?

Cold calling targeted by the Consumer Code (Article L.221-16) concerns calls to consumers. Calling a professional about their business remains possible, provided GDPR is respected: known source of contact details, documented legal basis, information provided to the person, and immediate respect of the right to object.

SituationPossible?Condition
Calling an executive about their businessYesGDPR respected, right to object honored
Calling an individual without consentNoProhibited since August 11, 2026
Calling an individual who has given consentYesPrior consent, proven and removable
Calling a client about an active contractYesThe call must concern that contract

Best practices for a sales team

  • Clearly separate professional files from any personal contacts.
  • Note the source of every imported file.
  • Add anyone who no longer wishes to be called to the opt-out list immediately upon request.
  • Introduce yourself clearly in the first sentence and never mask your number.
  • Have practices reviewed by a lawyer if in doubt.
